Predictive Policing (736A/22)

Request

I write to request information and records under the Freedom of Information Act (FOIA) 2000 regarding your force’s use of data analysis systems, automated decision-making systems, machine-learning and artificial intelligence.

 Specifically, I would like the following information:

 1.Is your force using predictive location or geographic crime or incident mapping systems? If yes,

 Please provide details of which system(s) your force is using, including:

The date it started being used;

 What the purpose of the system is and who are the primary targets of the system;

 What data the system uses and the sources of that data;

 What outcomes the system’s decisions or outputs lead to;

 Data Protection Impact Assessment and Equality Impact Assessments which have been conducted;

 Any internal reviews, reports or assessments of the operation of this system(s).

 2. Is your force using individual risk assessment systems which involve data analysis, automated decision-making, machine-learning and/or artificial intelligence?

 If yes, please provide details of which system(s) your force is using, including:

The date it started being used;

 What the purpose of the system is and who are the primary targets of the system;

 What data the system uses and the sources of that data;

 What outcomes the system’s decisions or outputs lead to;

 Data Protection Impact Assessment and Equality Impact Assessments which have been conducted;

 Any internal reviews, reports or assessments of the operation of this system(s).

3.Is your force using any other predictive, profiling or risk assessment systems, which involve data analysis, automated decision-making, machine-learning and/or artificial intelligence?

 If yes, please provide details of which system(s) your force is using, including:

The date it started being used;

 What the purpose of the system is and who are the primary targets of the system;

 What data the system uses and the sources of that data;

 What outcomes the system’s decisions or outputs lead to;

 Data Protection Impact Assessment and Equality Impact Assessments which have been conducted;

 Any internal reviews, reports or assessments of the operation of this system(s).

Response

We can confirm that some relevant information is held by West Midlands Police. However, while the majority of the information is attached to this email I am afraid that I am not required to release all of the information requested.

REASONS FOR DECISION

The redacted information is exempt by virtue of the following exemptions

Section 31 (1) Law Enforcement

Section 40 (2) Personal Data

In line with the above, I am required to complete a Prejudice Test/Public Interest Test (PIT) on disclosure. Please find this PIT attached below.

Section 40(2) is an absolute and class-based exemption if to release the information exists would breach the third party’s data protection rights.  In this case to release this personal information would not constitute fair processing of the data. As this exemption is class based I am not required to identify the harm in disclosure and in this instance I believe that the right to privacy outweighs any public interest in release.
