Request

1 The annual statistical summary of the total number of warranted police officers within your police force area for each year in the period 2011 – 2021.

2.The annual statistical summary of warranted police officers within your police force area who were recorded as having obtained a criminal record during the period 2011 – 2021.

3.The annual statistical summary breakdown of criminal records obtained by warranted police officers within your police force area during the period 2011 – 2021, disaggregated by ‘summary’, ‘either way’ and ‘indicatable’ offence categories.

4.The annual statistical summary breakdown for criminal records obtained by warranted police officers within your police force area during the period 2011 – 2021, disaggregated by listed offence type, within each of the three main offence categories (summary, either way, indictable).

5.The annual statistical summary breakdown for warranted police officers within your police force area who obtained a criminal record during the period 2011 – 2021 within each of the aforementioned offence types (see 4 above) disaggregated by their station district post code (e.g. NG1), as well as their age, ethnicity and gender.

6.The annual statistical summary breakdown of the origin of referrals to your police force of criminal records obtained by warranted police officers during the period 2011 – 2021 (e.g. officer self-disclosure, disclosure from another force, disclosure court).  Please provide these broken down by your police force area’s own categorisation of referral origin and disaggregate by criminal record offence types (see 4 above).

7.The annual statistical summary breakdown of whether cases referred to your police force regarding criminal records obtained by warranted police officers during the period 2011 – 2021, were or were not then subject to further investigation by the Professional Standards Directorate (PSD) and/or the Independent Office for Police Conduct (IOPC), disaggregated by criminal record offence types (see 4 above).

8. he annual statistical summary breakdown of your recorded outcomes for non-referrals for further investigation by the PSD/IOPC (e.g. no further action, warning, dismissal) related to cases of criminal records obtained by warranted police officers within your police force area during the period 2011 – 2021. Please provide this information disaggregated by criminal record offence types (see 4 above).

9 The annual statistical summary breakdown of recorded outcomes of PSD/IOPD investigations within your police force area related to cases of criminal records obtained by warranted police officers during the period 2011 – 2021 (e.g. no further action, warning, dismissal).  Please provide this information disaggregated by criminal record offence types (see 4 above).

10.The annual statistical summary breakdown of the number and outcome of appeals against dismissal made by warranted police officers within your police force area who obtained a criminal record during the period 2011 – 2021, disaggregated by criminal record offence types (see 4 above).

11.The annual statistical summary breakdown of your recorded outcome of appeals against dismissal made via the High Court in England and Wales, by warranted police officers who obtained a criminal record during the period 2011 – 2021, disaggregated by criminal record offence types (see 4 above).

Please be advised that the information that you have requested is not available in a readily retrievable format. In relation to Question 2,5 and 6.

This information is not centrally held in a retrievable format in respect if officers have a conviction. West Midlands Police currently has in excess of 8,000 Police Officers and PCSO and each one would need to be PNC checked to see if they have obtained a criminal record.

Therefore, the cost of providing you with the information is above the amount to which we are legally required to respond i.e. the cost of locating and retrieving the information exceeds the ‘appropriate level’ as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.

In accordance with the Freedom of Information Act 2000, this letter acts as a Refusal Notice for this part of the request and if one part of a request exceeds the fees limit then S12 of the Act applies to the whole request

However, In accordance with Section 16 of the Act I have a duty to provide advice and assistance in relation to your request and can provide the majority of the information requested.
