Warrant card misuse (861A/23)

Request

 

  1. How many investigations have been launched into warrant card misuse within West Midlands police since 2018?
  2. Of these, how many are still awaiting a conclusion?
  3. Of these, please list the reasons why an investigation has taken place, or continues to take place. For example; avoiding train fines, being drunk, obtaining discounts, a manner to obtain advantage over honest member of public. Please note this list is not exhaustive so I welcome all information of reasons why.
  4. Of these, please list the outcome of each warrant card misuse investigation e.g. a formal warning; management action; reflective practice; a case to answer but no action.

Response

Our data are not organised in such a way as to allow us to provide this information within the appropriate (cost) limit within the Freedom of Information (FOI) Act (see ‘Reason for Decision’ below).

Whilst the Police (Conduct) Regulations does have an allegation for ‘abuse of position for other purpose’, we do not specifically have an allegation for warrant card misuse.  Therefore, in order to accurately answer this request, we would need to manually have to read 918 conduct matters created within the time frame. At a minimum of 10 minutes each to assess the file, this would take 153 hours which exceeds the 18 hours for the purposes of the FOI Act.

I am unable to suggest any practical way in which your request may be modified in order to satisfy your query or bring it within the 18 hours stipulated by the Regulations. I am however willing to consider any refinements that you are able to make to your request, in accordance with Section 16 of the Freedom of Information Act.  If you would like to look into refining your request please contact me.
