Vehicle Fleet & Sold (1381A/23)
Please can you supply me with the following information?
of a) all vehicles currently on your fleet list and b) all vehicles sold between 14/11/2022 – 05/09/2023
a) Vehicles currently on your fleet list – Under Section 21 of the Freedom of Information Act, we are not required to provide information in response to a request if it is already reasonably accessible to you. b) Vehicles sold between 14/11/2022 to 05/09/2023 – I can confirm that this information is held by West Midlands Police. However, we are withholding some of that information since it is exempt by virtue of; Section 40(2) Personal information.

In the fleet list published at the link detailed above, we do not disclose the Vehicle Registration Marks (VRMs) of our vehicles.
Therefore, once one of our vehicles are sold at auction, the registration number of the car is no longer our data, it belongs to the person who has purchased the car.
Section 40(2) is an absolute and class-based exemption if to release the information exists would breach the third party’s data protection rights. In this case to release this personal information would not constitute fair processing of the data. As this exemption is class-based I am not required to identify the harm in disclosure and in this instance, I believe that the right to privacy outweighs any public interest in release.
I can however provide the following table which shows the make, model, and number of vehicles that went to auction during the requested period:
