  1. How many people did your force release ‘under investigation’ each month from June 2018 up to and including August 2021?

 

  1. For request 1, please may this be split by crime sub groups for all crime types (see HO Offence Classification index? For example, violence against the person offences are split into homicides, violence with injury, violence without injury, stalking and harassment, death or serious injury caused by unlawful driving)?

 

  1. For request 1, for each month, please can you state the average number of days these individuals were under investigation (prior to being charged or any other outcome was given)?

 

-Pre-charge bail

 

  1. How many people did your force release on pre-charge bail each month from June 2018 up to and including August 2021?

  1. For request 4, for each month, please can you state the average number of days these individuals were placed on pre-charge bail (prior to being charged or any other outcome was given)?

Please be advised that the information that you have requested is not available in a readily retrievable format. In relation to –

 

Question 2 / 4  Our Custody systems do not record information in relation to offence code therefore each record would need to be located and retrieved and the summary read to see what offence the individual  had been taken into custody for. This would then need to be cross referenced with additional systems to assign it to the relevant Home Office code, to enable us to produce this data.

 

Question 3 / 6  – Our systems do not record information in relation to averages of length of people being released and when charges were given as this is a dynamic system and overwrites any information that was entered previously.

 

Each Custody record would need to be located and retrieved and the summary read to see if there were updates made to each record

 

Therefore the cost of providing you with the information is above the amount to which we are legally required to respond i.e. the cost of locating and retrieving the information exceeds the ‘appropriate level’ as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.

 

In accordance with the Freedom of Information Act 2000, this letter acts as a Refusal Notice for this part of the request and if one part of a request exceeds the fees limit then S12 of the Act applies to the whole request

 

However, In accordance with Section 16 of the Act I have a duty to provide advice and assistance in relation to your request and can provide some information, please see attached.

 

This should not be taken as a precedent that additional information would be supplied outside of the time/fees legislation for any subsequent requests
