  4. Of these arrests, how many were found to be members or had links to a proscribed far-right groups such as National Front, Britain First etc.?
  5. If you have the data, how many of the arrests made between June 2021 and May 2022 involved individuals who wore pin badges, used flags, or were wearing any symbol relating to proscribed far-right groups?

In relation to questions 4 and 5, West Midlands Police will neither confirm nor deny the existence of any relevant data by virtue of Section 40(5) – Personal information.

Section 40(5) is an absolute and class-based exemption if to confirm or deny that the information exists would breach the third party’s data protection rights. In this case, to confirm or deny the existence of personal information would not constitute fair processing of the data. As this exemption is class based I am not required to identify the harm in disclosure and in this instance I believe that the right to privacy outweighs any public interest in release.
