Please find enclosed our response.

Q1. Legislation in regard to medicinal cannabis

The legislation in regard to Medicinal cannabis is available through a simple google search. You state above that you have already looked at the legislation, but just find it vague and confusing.

To clarify West Midlands Police position in regard to the legislation.

If a person has legitimate possession of Medical Cannabis then there should be no issues providing it has been prescribed in the name of the person in possession and it is being used in the manner it has been prescribed. Some of the private companies will give you a special ID card but some do not.  It is important that any medicinal Cannabis is kept in its original container which should have the patients details on etc.  There is a limit currently of 30 days’ supply.  There are responsible use guidelines which should be found/given upon receipt of medicinal Cannabis.

Also, the previously published FOI may be of some interest to you (please note this is 2022)

Q2. Resource made available to officer in regard to how to deal with medicinal cannabis

Q3. Information on how officers are trained in dealing with medicinal cannabis, such as training programmes and initiatives

Question 2 and 3 can be answered together.

West Midlands Police have designed and delivered Medicinal Cannabis training to the vast majority of front-line officers, this has also been bolstered by an internal news bulletin.

These resources are available to all in the form of:

Internal intranet bulletins

A training power point that has been delivered to online officers

As recommended as good practice by the Information Commissioner’s Office a version of this response may be published on the West Midlands Police website.
