1. In each of the calendar years 2020 and 2021 – how many recorded offences did your force record in each of the offence categories listed below – where an e-scooter was recorded as being part of the criminal offence.
Public Order Offences:
Public Fear Alarm or Distress

2. For each of the calendar years 2020 and 2021 what was the total number of fixed penalty notices (FPN) issued by your force where the recipient of the FPN was riding or in possession of an e-scooter at the time of the recorded offence.
Response
Please be advised that in relation to question 1, offence information is recorded on Police systems as per the Home Office Counting Rules for recorded crime (HOCR), governed by the National Crime Recording Standard (NCRS) and retrieval of information is subject to these recording categories. There is no recording category for an e-scooter being part of a criminal offence and, therefore, we are unable to search force recording systems for this specific information. In order for us to identify the relevant offences, we would have to carry out a manual examination of each offence to try to identify information that would be relevant to your request.
Therefore, the cost of providing you with the information is above the amount to which we are legally required to respond i.e. the cost of locating and retrieving the information exceeds the ‘appropriate level’ as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.
In accordance with the Freedom of Information Act 2000, this letter acts as a Refusal Notice for this part of the request and if one part of a request exceeds the fees limit then S12 of the Act applies to the whole request
However, In accordance with Section 16 of the Act I have a duty to provide advice and assistance in relation to your request and can provide the information requested for question 2 as this was retrieved during our initial research. This should not be taken as a precedent that additional information would be supplied outside of the time/fees legislation for any subsequent requests.
