Driving Offences (1616A/22)

Request

Please can you share the total number of driving offences which were classed as ‘careless or inconsiderate driving’. If possible, please only include those offences which did not result in death or serious injury. I refer to the following endorsement codes: (Source: https://www.gov.uk/penalty-points-endorsements/endorsement-codes-and-penalty-points ):

  • CD10 – Driving without due care and attention
  • CD20 – Driving without reasonable consideration for other road users
  • CD30 – Driving without due care and attention or without reasonable consideration for other road users

I would be grateful if this data could be provided in the same data table format as your previous response. I would like to request:

  • The total number of ‘careless or inconsiderate driving’ offences recorded in the last 2 years by West Midlands Police in the Birmingham city area, from 1/11/20 – 1/11/22
  • A breakdown of these offences by category, for example X number of offences for ‘driving without due care and attention’, X number of offences for ‘driving without reasonable consideration for other road users’ etc.
  • The total number of ‘careless or inconsiderate driving’ offences recorded in the last 2 years by West Midlands Police in the Coventry city area, from 1/11/20 – 1/11/22
  • A breakdown of these offences by category, for example X number of offences for ‘driving without due care and attention’, X number of offences for ‘driving without reasonable consideration for other road users’ etc.

Response

Our data are not organised in such a way as to allow us to provide this information within the appropriate (cost) limit within the Freedom of Information (FOI) Act (see ‘Reason for Decision’ below).

However, although excess cost removes the force’s obligations under the Freedom of Information Act, as a gesture of goodwill I have supplied information, relative to your request, retrieved before it was realised that the fees limit would be exceeded (see following tables). I trust this is helpful, but it does not affect our legal right to rely on the fees regulations for the remainder of the request.

REASON FOR DECISION

The requested offences are non-notifiable and as a result, not recorded on the crime system that was used to obtain data for your previous request (ref: 1582A/22). Instead, these offences are recorded on our PentiP (Penalty Notice Processing) system. This system however doesn’t allow us to easily ascertain the location the ticket was issued. Therefore, to determine only those offences that occurred in Birmingham and Coventry, we would need to manually review each case. This though would involve the examination of nearly three thousand tickets and such a search would exceed the appropriate limit (FOIA, s.12).

This means that the cost of compliance with the whole of your request is above the amount to which we are legally required to respond, i.e. the cost of locating and retrieving the information would exceed the appropriate costs limit under section 12(1) of the FOI Act 2000. For West Midlands Police, the appropriate limit is set at £450, as prescribed by the Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004, S.I. 3244.
