Q1. How many officers currently (as of today, 18 May) work in the force’s unit that deals with professional standards. I believe this would be called the Professional Standards Department or the Directorate of Professional Standards, but the unit may have a different name.
Q2. Of those, how many have been subject to disciplinary proceedings?
Q3. For each case please share the following information:
– The year of the disciplinary proceedings
– A summary of the allegation
– The outcome of the disciplinary proceeding (e.g. whether the allegation was upheld)
– What disciplinary action was taken, if any

Q2 & Q3 – West Midlands Police will neither confirm nor deny the existence of any relevant information by virtue of Section 40(5B) – Personal information.

Section 40(5B) is an absolute and class-based exemption if to confirm or deny that the information exists would breach the third party’s data protection rights. In this case to confirm or deny the existence of personal information would not constitute fair processing of the data. As this exemption is class based, I am not required to identify the harm in disclosure and in this instance, I believe that the right to privacy outweighs any public interest in release.
