Violence Against the Person Offences on Educational Premises (13861/19)



Please may I have the data for those assaults classified under ‘Violence Against the Person’ (so no need to include sexual assaults for this request).


1.         How many reports of assaults did your police force attend on education premises in the past five years (2014 to present)?

I would like the information broken down by:

a)         Date

b)         Type of education setting (nursery/ preschool, primary school, secondary school and college/ university)

c)         Name of establishment

d)         Nature of assault (whether it involved children v children/ teacher v child/ teacher v teacher or a parent etc)

e)         The outcome (were charges brought?).


Please be advised that the information that you have requested for 1b) and 1d) is not available in a readily retrievable format. This is because we do not have a recording category on our systems to identify the type of education setting or the nature of the assault (whether it involved children/teachers etc). The only relevant location marker that we have on our crimes database is for educational establishments, however, to further identify the type of setting (primary/secondary etc) would require a manual examination of each recorded offence location. It is for these reasons that we are unable to provide an answer for 1b) and 1d) without manually examining each case.

Therefore, the cost of providing you with the information is above the amount to which we are legally required to respond i.e. the cost of locating and retrieving the information exceeds the ‘appropriate level’ as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.

In accordance with the Freedom of Information Act 2000, this letter acts as a Refusal Notice for this part of the request and if one part of a request exceeds the fees limit then S12 of the Act applies to the whole request.

However, in accordance with Section 16 of the Act I have a duty to provide advice and assistance in relation to your request. Therefore, I have supplied information for 1), 1a) and 1e) in the attached document as this was retrieved during our initial research. For 1d) I have supplied the age of the victim and defendant in each case.

Please also be advised that to release information for 1c) would attract exemptions Section 30 (Investigations) and Section 40 (Personal information).

This should not be taken as a precedent that additional information would be supplied outside of the time/fees legislation for any subsequent requests.
