The Smokefree (Private Vehicles) Regulations make it an offence to smoke in a private vehicle carrying children. Information shared with police forces in April, through the NPCC, advised that for offences of smoking in private cars police officers may use the traffic offence report (TOR) form to pass information to local authorities for them to consider taking enforcement action, if appropriate.
The Department of Health is gathering information on activity related to these offences, including passing of information to local authorities to consider issuing fines. We would be grateful if you could provide the following information on behalf of your police force:
Number of verbal warnings issued;
Number of offences reported to the local authority to issue a fine (via a TOR)
