Q1 – How many complaints have been received in the past five years relation to alleged racial discrimination by officers/staff?

Q2 – Have any been upheld? If so, how many?

Q3 – Can you please provide details about each upheld complaint (ie the nature of complaint, date committed, number of officers involved etc)?

Q4 – In each case where a complaint was upheld, what action was taken against individuals concerned?

Q5 – How many allegations of racial discrimination were referred to the IOPC in the past five years?

Response

We can confirm that some relevant information is held by West Midlands Police. However, while the majority of the information is attached to this email I am afraid that I am not required to release all of the information requested. In particular information in relation to question 3 and 4 above will not be released.

Please be advised that any information released as a result of a Freedom of Information request, in effect, is being released into the public domain. Therefore, it could subsequently be published or would have to be made available to any member of the public if it were requested.

Any information that relates to an individual, or from which an individual could be identified, constitutes personal data and to release information that constitutes personal data into the public domain contravenes the Data Protection Act and GDPR.

The information that you have requested pertains to that of a third party/parties, namely those officers / staff with a complaint lodged against them. To release information in relation to a third party under the Freedom of Information legislation would in itself place such information into the public domain and would be in breach of the Data Protection principles, it is therefore exempt from disclosure, the exemption that applies to this type of information is Section 40 of the Freedom of Information Act 2000.
