How many times has your force used Section 136 of the Mental Health Act to detain someone under the age of 18? Please provide the figures for financial years 2011/12, 2012/13 and 2013/14 to date.

For each year please state how many of the detentions of under 18s under section 136 resulted in the person being detained to an NHS place of safety, and how many resulted in the person being detained to a police custody suite.

Can you also provide me with the age of the youngest person detained in a police custody suite under section 136 of the Mental Health Act in each of the above years?


West Midlands Police have detained just one person aged 17 in 2011/12 for one day under the Mental Health Act (MHA)

Over the past couple of years it has been unusual for individuals to be detained under the MHA. In most cases people are arrested for an offence and then they are found to have mental health issues. However, if someone is behaving in a manner in which officers believe is due to mental health issues the appropriate health workers are contacted and the person is taken immediately to a hospital or mental health facility rather than being brought/taken into a custody suit.
