Request

Under the terms of the Freedom of Information Act 2000, please provide me with a full copy of your Force Management Statement.

This is a document requested by HMICFRS but which is owned by the force – https://www.justiceinspectorates.gov.uk/hmicfrs/about-us/what-we-do/integrated-peel-assessments/force-management-statements/ – and I understand there is no impediment to it being released under FOI.

If a final version is not available, please send me a draft.

Response

We can confirm that information is held by West Midlands Police. However, while the majority of the information is attached to this email I am afraid that I am not required to release all of the information requested. Please find attached a redacted document.

REASONS FOR DECISION

The redacted information is exempt by virtue of the following exemptions

Section 31 (1) (a) (b) (Law enforcement)

Section 40 (2) Personal Information

Section 24(1) National Security

Section 23(1) Information Relating to Security Bodies

Section 23(1) is an absolute class-based exemption and therefore there is no requirement to conduct a harm or public interest test

Section 40(2) is an absolute and class based exemption if to release the information exists would breach the third party’s data protection rights. In this case to release this personal information would not constitute fair processing of the data. As this exemption is class based I am not required to identify the harm in disclosure and in this instance I believe that the right to privacy outweighs any public interest in release

Sections 24, and 31 are prejudice based qualified exemptions and there is a requirement to articulate the harm that would be caused in confirming or not that the information is held as well as carrying out a public interest test.

In line with the above, I am required to complete a Prejudice Test/Public Interest Test (PIT) on disclosure. Please find this PIT/s attached
