Spit Hoods (6743_15)

Request

Pursuant to section 1(1) of the Freedom of Information Act 2000 I should be grateful if you would provide the following information:

 

  1. Documents recording your force¿s policy on the provision of appropriate adults to the following categories of detainee:

 

(a)        Children detained under section 136 of the Mental Health Act 1983 (`MHA¿);

(b)        Adults detained under section 136 of the MHA;

(c)        Children detained under PACE;

(d)        Adults detained under PACE.

 

  1. Your equality impact assessments concerning the above policies.

 

  1. Documents (training notes, handouts, Powerpoint slides, etc) used to train or instruct your custody sergeants as to when and in what circumstances they should call an appropriate adult to attend the above categories of detainee.

 

  1. The following information for the most recent 12 month period (or such other period for which information is available):

 

(a)        The number of children detained by your force under section 136 MHA;

(b)        Of those children, the number who were provided with an appropriate adult;

(c)        The number of adults detained by your force under section 136 MHA;

(d)        Of those adults, the number who were provided with an appropriate adult.

  1. Over the last 5 years, or such other period for which you are able to provide information, please confirm how many of your officers have been spat at whilst on duty.  In each instance please confirm:

 

(a)        The year in which the incident took place;

(b)        The circumstances in which the spitting took place;

(c)        Any medical condition developed by the officer as a result of being spat at, the treatment they received and any lasting injury suffered.

 

  1. Whether any of your officers are authorised to use `spit hoods¿ or similar devices as described at pages 82 and 83 of Module 4 of the ACPO Personal Safety Manual.

 

(a)        If some or all of your officers are authorised to use a spit hoods please provide copies of:

(i)         Your equality impact assessment concerning your policy on the use of spit hoods;

(ii)        Guidance and training documents issued to officers concerning the use of spit hoods;

(iii)       Minutes of meetings at which the use of spit hoods was discussed;

(iv)       Risk assessments;

(v)        Internal and external correspondence regarding the use of spit hoods.

 

(b)        If some or all of your officers are authorised to use a spit hoods please also provide the following information for the most recent 12 month period or such other period for which information is available:

 

(i)         The number of adults upon whom spit hoods were used during detentions under PACE;

(ii)        The number of adults upon whom spit hoods were used during detentions under the MHA;

(iii)       The number of children  upon whom spit hoods were used during detentions under PACE;

(iv)       The number of adults upon whom spit hoods were used during detentions under the MHA.

 

(c)        If none of your officers are authorised to use spit hoods please confirm the rationale for this position and provide relevant documents.

 

  1. Details of any equipment issued to you officers aimed at mitigating the risk of being spat at other than spit hoods e.g. goggles or facemasks to be used by the officers themselves.
