Request

I understand from the Police and Crime Commissioner’s Office that the West Midlands Police has a Memorandum of Understanding (MOU) with the local prison which defines what an “assault on a prison officer” is and the types of incidents suitable for prosecution.

Please could you forward the information to me under the FOI Act?  Please forward the MOU in full and should you need to redact any information, please only remove the relevant portion and release the remainder of the information.

Please also note, if this document is not known as a “memorandum of understanding”, please provide details of whatever document you have which defines what an “assault on a prison officer” is and the incidents deemed suitable for prosecution.

West Midlands Police do not have a specific Memorandum of Understanding (MOU) with the local prison service that defines what an “assault on a prison officer” is and the types of incidents suitable for prosecution.  We adhere to the national guidance in respect of crime investigations and strictly follow the National Crime Recording Standards (with particular notice to Section I – Other investigating authorities). Secondly, we apply the Prison Discipline Manual of 2005 – again looking at annex C which is titled Criminal Offences in Prison Service Establishments – agreed between the police, CPS and Department of Constitutional Affairs.
