I am writing to you under the Freedom of Information Act 2000 to request the following information from West Midlands Police.
Please could you provide me with a full list of motoring incidents which were a result of fatigued and/or tired drivers in your area, monthly from 2014 to 2019. Please could this information be broken down into the following categories:
- The number of incidents per month between 2014, 2015, 2016, 2017, 2018, 2019
- A count of actions taken per annum – for example, £9,000 in fines and 30 licence suspensions were issued in 2015
Our data are not organised in such a way as to allow us to provide this information within the appropriate (cost) limit within the Freedom of Information (FOI) Act (see ‘Reason for Decision’ below).
Please note that any located information might be subject to the application of exemptions under the Act.
Although excess cost removes the force’s obligations under the Freedom of Information Act, as a gesture of goodwill I have supplied information, relative to your request, retrieved before it was realised that the fees limit would be exceeded (see attached). I trust this is helpful, but it does not affect our legal right to rely on the fees regulations for the remainder of the request.
REASON FOR DECISION
Please note that researching each individual case would exceed the appropriate limit (FOIA, s.12). We are unable to provide details of fines / licence suspensions. Recording of outcomes in our database is not reliable and would involve a manual search of all relevant records in order to locate and retrieve this information, in addition fines and licence suspensions are issued by HMCTS not West Midlands Police.
