Child Sexual Offences (2394_16)

Request

The number of allegations your force has investigated between January 1, 2013, and December 31, 2015, of either of the following offences in which one or more of the suspects was aged 18 or less:

a) causing or inciting a child to engage in sexual activity

b) causing or inciting a child under 13 to engage in sexual activity

Please include a breakdown for each allegation stating:

  • the month/year
  • the outcome of the investigation, i.e. charge, NFA, out of court disposal etc.

By allegations I mean recorded crime

Below are the Home Office codes for the information I am seeking.

a) Sexual activity with a child under 13 by an offender under 18 years of age:

21/12 Female child – penetration

21/22 Female child – no penetration

21/13 Male child – penetration

21/23 Male child – no penetration (S/V)

b) Causing or inciting a child under 13 to engage in sexual activity by an offender under 18 years of age:

21/14 Female child – penetration

21/24 Female child – no penetration

21/15 Male child – penetration

21/25 Male child – no penetration (S/V)

21/16 Engaging in sexual activity in the presence of a child under 13 by an offender under 18 years of age (S/V) Sexual Offences Act 2003 Sec 13 (pt).

In addition, West Midlands Police can neither confirm nor deny that it holds any other information with regard to an exempt body, as the duty in Section 1(1)(a) of the Freedom of Information Act 2000 does not apply by virtue of the following exemption:

Section 23(5) Information supplied by, or concerning, certain Security Bodies.

Section 23 is a class based absolute exemption and there is no requirement to consider the public interest in this case. Confirming or denying the existence of whether any other information is held, would contravene the constrictions laid out within Section 23 of the Freedom of Information Act 2000, in that this stipulates a generic bar on disclosure of any information supplied by, or concerning, certain Security Bodies.
